Welcome to Wishop South Africa ("Wishop", "we", "our", "us"). These Terms of Use ("Terms") govern your access to and use of our website wishop.co.za (the "Platform"). By accessing, browsing, or using the Platform, you confirm that you have read, understood, and agree to comply with these Terms, along with all applicable laws and regulations. If you do not agree, you must not use the Platform.
1. Scope
These Terms of Use apply to all visitors, Customers, and Sellers who access or interact with Wishop. They define acceptable use of the Platform, outline prohibited conduct, and establish the responsibilities of each user. Additional policies (e.g. Privacy Policy, Returns Policy, Marketplace Terms & Conditions) form part of these Terms by reference.
2. Eligibility
- Users must be at least 18 years old or the legal age of majority in South Africa to register and use the Platform.
- Legal entities may register via authorised representatives who have authority to bind the entity.
- By registering, you confirm that the information you provide is accurate, truthful, and complete.
3. User Account
- Account creation – Customers and Sellers must create an account to access full features of the Platform. Accounts are personal and non-transferable.
- Credentials – Users must maintain the confidentiality of their login details. Wishop is not liable for unauthorised access caused by weak or compromised credentials.
- Account suspension – Wishop reserves the right to suspend or terminate accounts that violate these Terms, without prior notice.
4. Acceptable Use
Users agree to:
- Use the Platform solely for lawful purposes in accordance with South African law.
- Respect the rights of other Customers, Sellers, and Wishop staff.
- Ensure that all content provided (reviews, comments, listings) is accurate, lawful, and free from misleading or defamatory material.
Users may not:
- Use the Platform for fraudulent activities, scams, or to misrepresent identity.
- Upload viruses, malware, or harmful code that disrupts the Platform.
- Scrape, copy, or exploit Platform data without prior written consent.
- Engage in abusive behaviour, hate speech, harassment, or unlawful discrimination.
5. Intellectual Property
- The Platform’s design, software, graphics, trademarks, and content are owned or licensed by Wishop and protected by South African intellectual property law.
- Users are granted a limited, non-exclusive, non-transferable license to use the Platform for personal or commercial purposes as authorised under these Terms.
- No user may reproduce, distribute, or modify Platform content without prior written consent.
6. Content Provided by Users
- Customers and Sellers may post reviews, ratings, and product information subject to moderation.
- By submitting content, users grant Wishop a royalty-free, worldwide, non-exclusive license to use, reproduce, and display such content for Platform purposes.
- Wishop reserves the right to remove unlawful, offensive, or irrelevant content without notice.
7. Platform Availability
Wishop strives to ensure continuous access but does not guarantee uninterrupted or error-free operation of the Platform. Maintenance, technical issues, or force majeure events may result in temporary downtime. Wishop is not liable for damages resulting from such interruptions.
8. Limitation of Liability
- Wishop provides the Platform on an “as is” and “as available” basis, without warranties of any kind.
- To the fullest extent permitted by law, Wishop disclaims liability for indirect, incidental, or consequential damages arising from Platform use.
- Users are responsible for ensuring compatibility of their devices and internet connection with the Platform.
9. Third-Party Links
The Platform may contain links to third-party websites. Wishop does not control and is not responsible for the content, policies, or practices of such external websites. Accessing them is at the user’s own risk.
10. Termination
Wishop reserves the right to suspend or permanently terminate access to the Platform for violations of these Terms, fraudulent behaviour, or unlawful conduct. Users may also delete their accounts at any time via the Customer Account Page.
11. Privacy & Data Protection
Personal data is collected and processed in compliance with the Protection of Personal Information Act (POPIA) and Wishop’s Privacy Policy. By using the Platform, you consent to such processing.
12. Amendments
Wishop may update these Terms of Use from time to time. Material changes will be notified on the Platform. Continued use of the Platform after changes implies acceptance of the revised Terms.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved amicably shall be referred to the competent courts of South Africa.
